Article 1 Definitions


These Terms and Conditions of Sale (hereinafter referred to as « T&Cs ») are offered by Online Excellence LLC, with its headquarters located at St louis, 63121 MO. (Hereinafter referred to as Tail Tendance.


The following terms will be defined as:

Site: the website https://tailtendance.com and all its pages, owned exclusively by the Company.

Products or Services: all products (physical goods) and services (services) available for purchase or subscription through the Site.

Seller: Tail Tendance, the legal entity or individual offering the Products or Services on the Site.

Customer: the user, whether an individual or business, who makes a purchase of Product(s) or Service(s) on the Site.

Consumer: as defined under U.S. law, a person acting for purposes unrelated to their commercial, industrial, or professional activities.


By visiting the Site and being interested in the Products and Services offered by the Seller, the Customer is invited to read these T&Cs carefully, print and/or save them on a durable medium before proceeding with any order on the Site.


The Customer acknowledges having read and accepted these T&Cs in their entirety.


Article 2 Application of T&Cs and Purpose of the Site


The Seller reserves the right to modify these T&Cs at any time by posting a new version on the Site.


The T&Cs applicable to the Customer are those in effect on the day of the order placed on the Site.


The legal information about the Site host and publisher, the collection and processing of personal data, and the Site's terms of use are provided in the Site's privacy policy and legal notices.


The Site offers the online sale of Dog's products.


The Site is freely accessible to all Customers. By purchasing a Product or Service, the Customer accepts these T&Cs in full, acknowledging that they have read them. This acceptance may involve the Customer ticking a box next to a statement such as acknowledge having read and accepted the full terms and conditions of the Site. The act of ticking this box will be considered as equivalent to a handwritten signature.


Acceptance of these T&Cs implies that the Customer has the legal capacity to do so. If the Customer is a minor or lacks this legal capacity, they must have authorization from a guardian or legal representative.


Article 3 Customer Service


Customer service can be contacted by email at: contact@tailtendance.com, via the online form, or by mail at the address provided in the legal notices. The Customer should provide their name, order number, and the subject of their inquiry.


For business-related inquiries (partnerships, media, contract proposals), the Company can be reached only by email at: contact@tailtendance.com.


Article 4 Ordering Process and Purchase Description


The Products and Services offered are those listed in the catalog published on the Site. Each product is accompanied by a description provided by the Seller based on the supplier details.


Photos on the Site are non-binding and may vary from the actual products due to display settings, lighting, or angles of photography.


The Shopping Cart is the virtual item containing all Products or Services selected by the Customer for purchase. To place an order, the Customer selects the Product(s) they wish to purchase and adds them to the Cart, which can be modified at any time.


The process is as follows:

1. The Customer places an order on the Site by registering and confirming their order.

2. The Customer selects Products from the catalog and clicks the Add to Cart. The Shopping Cart allows the Customer to review their order and make corrections.

3. On the Information page, the Customer enters contact details and can opt for email notifications.

4. On the Shipping page, the Customer selects a shipping method.

5. On the Confirmation page, the Customer enters payment information and billing address and may apply a promo code if applicable.

6. A complete order summary appears, and the Customer can modify it before finalizing. The Customer is responsible for any errors in the order.

7. The sale is finalized when the Customer confirms the order and accepts the T&Cs, completing payment as per the chosen method.


Article 5 Prices and Payment Methods


Unless otherwise specified, prices listed in the catalog are in U.S. Dollars, inclusive of taxes (if applicable), and exclude any additional charges for shipping and handling.


Tail Tendance reserves the right to adjust prices in the event of changes in tax rates or for other reasons. The price valid at the time of order is the only one applicable to the Customer.


The Customer can pay for orders using credit cards, Apple Pay through secure payment processors.


Payment details are processed directly between the Customer and the payment provider; the Site does not store payment information.


For bank transfers, the shipping process starts only after the Seller receives payment confirmation.


Article 6 Shipping


Shipping fees will be disclosed to the Customer before payment. Orders can be shipped worldwide.


Shipping times are indicative and may be delayed due to postal issues, adverse weather, or other unforeseen events.


For international shipments, the Customer is the importer of record and may be subject to customs duties or taxes specific to their country.


The Seller commits to delivering products within thirty (30) days of the contract conclusion, unless otherwise agreed.


The Customer can refuse delivery if they notice issues with the shipment, such as damage or missing items, and must note these issues on the delivery receipt.


Article 7 Right of Withdrawal and Withdrawal Form


The Consumer has the right to withdraw from the contract within fourteen (14) days of receiving the product without providing any reason. To exercise this right, the Customer must return the product in perfect condition within fourteen (14) days of notifying the Seller.


Refunds will be processed using the same payment method, unless otherwise agreed, and may be delayed until the product is returned, or proof of return is provided.


Article 8 Product Warranty


U.S. law provides for warranties of merchantability and fitness for a particular purpose. The Customer may request a replacement or refund if the product is defective or does not conform to the contract.


Article 9 Liability


The Seller is not liable for any failure to perform the contract due to force majeure events. The Seller is also not responsible for indirect damages resulting from product use, including loss of profits or data.


The Seller is not liable for incompatibilities or issues resulting from improper use or configuration by the Customer.


Article 10 Force Majeure


Force majeure events, which prevent the Seller from fulfilling their obligations, suspend the contract. If the force majeure persists for more than ninety (90) days, either party can cancel the contract by written notice.

This section outlines the terms related to personal data processing, comments and proposals from users, and dispute resolution in the context of the company's general terms and conditions.


Article 12 Personal Data Processing

1. The company collects personal data from the client:

 (a) To process and track the client's order on the website.

(b) To contact the client about events related to the company, including product updates and customer relationship management.

 (c) To gather information that allows the improvement of the website and products (e.g., via cookies).

2. Data is processed by third-party service providers, including packaging and delivery services, and Shopify Inc., which hosts the website and ensures secure servers protected by firewalls.

3. Collected data is retained for a period corresponding to the purposes mentioned above, not exceeding five years.

4. Clients have rights under the General Data Protection Regulation (GDPR), including access, modification, deletion, or opposition to their data. These rights can be exercised by email at contact@tailtendance.com.


Article 13 User Comments and Proposals

1. Any comments, ideas, or proposals sent to the company may be edited, copied, published, and distributed by the company at its discretion.

2. The company is not obligated to maintain confidentiality, compensate, or respond to these comments.

3. The client must ensure that comments do not violate third-party rights or contain harmful content such as viruses, defamatory language, or malware.


Article 14 Independence of Clauses

1. If any clause in the terms and conditions is deemed illegal or unenforceable, it will not affect the validity of the other clauses.

2. The terms and conditions replace any prior agreements, and the client cannot transfer or sublicense these terms.


Article 15 Applicable Law and Mediation

1. The company reserves the right to pursue legal action in cases of fraudulent purchases.

2. Disputes may be submitted to mediation, with a certified mediator facilitating the resolution process. The United States Commission's website offers further information about this process.

3. The company may pursue criminal charges for fraudulent actions and will not accept attempts at amicable settlement in such cases.


Guarantee


The company offers a 30-day guarantee on parts, with exclusions for external factors causing damage. In such cases, the company will replace the defective part.
